Terms And Conditions

STADIUMS QUEENSLAND CORPORATE HOSPITALITY

These Terms and Conditions (T&Cs) apply to the purchase of a Corporate Hospitality Package OR Corporate Hospitality Suite (Package) by an entity (Client) from Stadiums Queensland ABN 53 690 873 374 (SQ).
 
1. Prices and Payment 
 
  1. SQ will invoice and the Client must pay SQ the amount specified as the 'Total Cost’ for a Package as set out in the relevant invoice. The Total Cost and any other payments to be made under these T&Cs are inclusive of GST unless otherwise stated.
  2. Payment can be made by credit or debit card by Visa or Mastercard via the Securepay payment portal (Portal) or by direct deposit.
  3. Payment is required in full at the time of booking if paying via the Portal. If payment is being received via direct deposit, the Client must pay the invoice within 14 days from the date of invoice.
  4. If payment is not received during the time specified, SQ reserves the right in its absolute discretion to cancel the purchase of a Package.
  5. SQ is only required to provide the requisite tickets merchandise, services or other rights in respect of a Package to the Client after payment has been made in full and (if applicable) the invoice for that Package has been paid in full.
  6. If the Client wishes to put in place an account for food and beverage in addition to that provided in a Package, only one account is permitted per Package. Any account must be paid to SQ’s caterer prior to the conclusion of the event.
2. Permitted Use 
 
  1. Purchase of a Package permits the Client and any person whom the Client authorises (Guest) to make use of the Corporate Hospitality Package or Corporate Hospitality Suite, for the duration of the relevant event at the venue, in accordance with these T&Cs.
  2. A Package, either in full, or separated into individual tickets or benefits, must not be used by the Client or its Guests for any activity with the intent to gain commercial advantage of any kind, including re-sale, marketing promotions, prizes or incentives, recruitment campaigns, public relations, brand promotion, market research or consumer data collection, fundraising or political or cause-related campaigns.
  3. A Client is not permitted to make use of a Package for more than the maximum number of persons specified as part of the Package.
  4. In utilising the Package, the Client and Guests may consume only food and beverages supplied by SQ or its catering agent unless a Guest has dietary restrictions which are notified to SQ before the event and SQ has reasonably determined cannot be accommodated.
  5. Except with the prior written consent of SQ (which may be granted or refused in its absolute discretion), the Client must not assign a Package or any right under this agreement to any other party.
3. Event cancellation or changes 
 
  1. Due to circumstances beyond the reasonable control of SQ, including but not limited to act of God, state of emergency (e.g. bushfires or floods), public health emergency (e.g. pandemics), travel warnings (e.g. travel restrictions or advice to not travel), government directives (e.g. forced venue closures or mass gatherings restrictions), or at the direction of the event promoter, there may need to be a change to, or cancellation of, the event.
  2. A change to an event can include without limitation, an alteration of the event program, date, venue, seating arrangements, audience capacity, entertainment or associated activities.
  3. SQ will work with the promoter of an event to reschedule any event that is cancelled. However, the price of the Package is determined by specific event dates and venues and if the cost of the rescheduled event materially increases, SQ may provide a revised invoice for the rescheduled event, payment of which is required for the purposes of the Client having a Package for the rescheduled event. Otherwise, if there is a change to an event, the Package will remain valid for the event as amended.
  4. If the event is cancelled, or there is a material change to the event and the Client notifies SQ prior to the original date of the event that it wishes to cancel its Package as a result of the change, SQ will provide a refund for the Package.
  5. The refund amount for a Package is the amount invoiced for the Package and this is the total amount SQ is liable for due to a change or cancellation of an event. SQ is not liable for any expenses or other costs that the Client, a Guest, or any other person, incurs in connection with a change to or cancellation of an event, including travel, accommodation or delivery charges.
  6. Refunds will be issued using the same method of payment that was used to pay for the Package which may require the Client to provide payment details before payment can occur.
4. Package Limits
 
  1. SQ may impose limits on the number of Packages that may be purchased for any event and will advise of these limits prior to purchase of a Package.
  2. If the Client, or an entity associated with the Client, purchases a Package in excess of these limits, SQ may cancel the Package of the Client.
  3. An entity associated with a Client includes without limitation any related body corporate of the Client, or entity with the same name, e-mail address, billing address, credit card number, phone number or other identifying information.
  4. The benefits for a Package do not represent what each Guest receives, but what is allocated in respect of that Package. The Client is responsible for the distribution of any Package benefits among its Guests.
5. Lost/Missent Tickets
 
SQ is not required to refund, exchange, replace or substitute tickets that may have been stolen, lost, or destroyed, or missent by the Client, except as required by law.
 
6. Conditions of Entry
 
  1. The Client will read and comply with all conditions of entry of the venue, all laws, and any additional conditions of entry that may be required by the promoter for the event that are notified to the Client or made available on the official webpage for the event.
  2. The Client is also responsible for ensuring that all Guests are aware of, and will also comply with the conditions of entry of the venue and/or the promoter.
  3. The Client is responsible for ensuring that each Guest has a valid ticket and the Guest must retain that ticket for the duration of the event.
  4. SQ has prescribed minimum dress standards for corporate hospitality spaces within the respective venues. Dress code details will be notified to the Client. The Client must and must ensure all Guests conform to the dress code specified for the event.
  5. Smoking is prohibited and the Client will ensure that neither it nor its Guests smokes in or about the facility, other than in specially designated smoking areas at the venue.
  6. Alcohol cannot be taken outside of the area the subject of the Package and the Client will ensure that neither it nor its Guests take alcohol outside of that area.
  7. The Client will and must ensure that all Guests, comply with all reasonable directions given by officers, employees, or agents of SQ, relevant State authorities or the promoter including, without limitation, directions in connection with access to the event or conduct at the event.
  8. Any person who does not comply with the requirements of this paragraph 6 to the satisfaction of SQ or the promoter, may be refused entry or be required to leave the event and SQ is entitled to retain all amounts paid.
  9. In addition to removal from the venue, a failure to comply with the requirements of this paragraph 6 may result in the imposition of other sanctions, including receiving an official banning notice preventing the Client or Guest from attending the venue or other SQ venues in the future.
7. Entry to Children
 
  1. Certain events are not suitable for Guests under the age of 18. Where age restrictions apply, SQ will advise of the restriction at the time of promoting the event, or otherwise in advance of the Client purchasing tickets for that event.
  2. The Client may not have Guests under the age of 18 when these restrictions apply.
  3. Any Guest who is under 14 years of age must be accompanied and supervised at all times by their parent or guardian.
 
8. Advertising and Promotions
 
 The Client must not without obtaining the prior written consent of SQ:
  1. conduct any advertising or promotion whatsoever in relation to the Package or the event, including without limitation, any hospitality signage or hospitality identification;
  2. offer any part of the Package for advertising or other promotional purposes (including prizes, contests, or sweepstakes); or
  3. in any way imply or give the impression that the Client is a sponsor of SQ, the event or the venue, or is in some other way connected with SQ or the delivery of the event.
9. Damages to Property
 
  1. The Client is liable for any damages, destruction, or loss caused to the event, venue, or other property due to any negligent act or omission, or failure to comply with these T&Cs, by either the Client or its Guests.
  2. SQ reserves the right to inspect the room or property before and after the event. Any damages beyond fair wear and tear identified after the event may be attributed to the Client unless:
  1. prior damage was reported by or to SQ;
  2. the damage was the result of an act by a third party not authorised by the Client, and the damage was not otherwise attributable to the Client or a Guest; or
  3. the damage was solely caused by SQ or its personnel.
c. SQ may invoice the Client for all costs incurred in association with any repairs, replacements, or extraordinary cleaning required to restore the room or property to its original condition and the invoice must be paid within 14 days.
 
10. Limitation of Liability
 
  1. The Client and its Guest utilise the Package at the risk of the Client. To the full extent permitted by law, the Client releases SQ and its personnel from any and all liability resulting from any accident, loss, damage or injury to persons or property in the area the subject of the Package while occupied or used by the Client, except to the extent caused by SQ or its personnel.
  2. To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities, and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on SQ are excluded.
  3. Nothing contained in these T&Cs excludes, restricts, or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law, provided that, to the extent that the Australian Consumer Law permits SQ to limit its liability, then the liability of SQ is limited to:
  1. in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
  2. ii.in the case of goods, replacing the goods, supplying equivalent goods, or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
11. Privacy
 
  1. Stadiums Queensland manages personal information in accordance with the Information Privacy Act 2009, and is collecting your contact details, including your name, phone number, email address and postal address for the purposes of contacting you in relation to booking the Package, attending the event under the Package, purchasing food and beverage packages related to the Package, and
    associated corporate hospitality opportunities for the Green Day concert at Cbus Super Stadium (a Stadiums Queensland venue). The information collected will be used by Stadiums Queensland for this purpose and will only be accessed and used by authorised employees, officers and/or contractors of Stadiums Queensland.
  2. Except as provided for in this notice, personal information collected will not be disclosed to any other parties unless authorised or required by law. Where you provide your email address, and we contact you using this email address your information may be transferred overseas depending on the location of your email provider. By providing us with your email address you consent to this transfer of your personal information overseas.
  3. Personal information of individuals attending an event at the venue, including CCTV footage, is collected, used, disclosed and managed by Stadiums Queensland as set out in the Venue Conditions of Entry and in accordance with 'Stadiums Queensland Information Privacy Plan'.
